Felony criminal Defense
Felonies are serious cases where a person is facing a prison sentence. Felonies are only prosecuted in district courts and a felony conviction will result in the loss of many significant rights.
David has amassed a wealth of experience having represented approximately 1,000 people who have been charged with felonies.
Types of Cases
Misdemeanor Defense
Attorney David McDonald has successfully litigated misdemeanor cases in 25+ different courts. He has won trials to judges and juries at the misdemeanor level. Misdemeanor charges carry possible jail sentences of a year or less. Misdemeanor trials can be heard by either a judge or a jury of 6 people.
Felony Defense
David has specialized in representing people facing felony charges for the last 15 years. He has represented 500+ defendants facing felony charges. Felony charges carry the potential of prison time in addition to the loss of significant rights (to possess firearm, vote, ect.). Felony trials are typically decided by a jury of 12 individuals, but can also be tried to judges.
Expungements
An expungement is the process of having an old criminal conviction removed from your record. Often, people have no idea they are able to have their past indiscretions removed, but it is possible. If you have been off of supervision for more than 3 years, you may be eligible. David McDonald has been successful in helping dozens of individuals clean up their records. David has also been successful in front of the Kansas Court of appeals where he challenged the legality of the statute. As a result of David’s work, the law has been changed and many more people are now eligible for expungements.
What a lawyer does?
Counselor
A lawyer is a person who counsels a person through the legal process. While lawyers may give advice and dictate strategy, it is always the client’s decision concerning having a trial vs. taking a plea.
Investigator
lawyers (or good ones, at least) acts like an investigator for their client. They investigate the scene, they view the evidence that has been collected, they try to reconstruct the scene of the crime and diagram things out.lawyers (or good ones, at least) acts like an investigator for their client. Negotiator
Often lawyers work on behalf of their clients to negotiate plea bargains to cases. Sometimes a plea is negotiated because the client wants to simply accept responsibility and beg for mercy. Other times, due to the fear of being beaten badly in court by David McDonald, the prosecution makes a plea offer that is simply too good for a client to refuse. An example of this is when a defendant who is facing a large prison sentence, is presented a plea offer that allows them to walk out of jail. Those are deals that are hard for even innocent clients to refuse. However, the decision to enter or not enter a plea is that of a client and a client only.
